Terms of Service
These Terms of Service govern your use of TWI’s custom manufacturing services, engineering resources, and website. Please read them carefully to understand our mutual obligations regarding project quotations, production standards, and tooling ownership.
1. Quotations and Orders
Validity: Unless otherwise stated, all preliminary quotes provided via our website or email are valid for 30 days.
Final Pricing: Final manufacturing and tooling costs will be confirmed via a Proforma Invoice (PI) only after a comprehensive Design for Manufacturability (DFM) review of your final 3D CAD files.
Order Confirmation: Production (or tooling fabrication) will not commence until the PI is signed and the agreed-upon deposit or payment is received.
2. Intellectual Property Rights
Client Ownership: You retain 100% exclusive ownership of all intellectual property, including 3D designs, 2D drawings, patents, and trademarks submitted to TWI for manufacturing.
No Reverse Engineering: TWI guarantees that we will not copy, reproduce, or reverse-engineer your products for any internal use or third-party sales.
3. Tooling Ownership & Storage
Exclusive Ownership: Once custom injection molds or rapid tooling are fully paid for according to the agreed payment terms, the tooling becomes the exclusive property of the client.
Maintenance & Storage: If you choose to keep your molds at our facility for mass production, TWI will provide routine preventative maintenance at no additional cost for the guaranteed lifespan of the tool.
Tooling Transfer: You have the right to request the export and transfer of your molds to another designated facility at any time. Preparation and shipping costs for mold transfer will be borne by the client.
4. Quality Assurance & Acceptable Variations
Production Standards: All mass production is strictly guided by the approved First Article Inspection (FAI) report and the signed "Golden Sample" provided during the T1/T2 trial phase.
Dimensional Tolerances: Parts will be manufactured according to the agreed-upon 2D drawing tolerances. If no specific tolerances are provided, standard DIN ISO 2768 commercial tolerances for plastics will apply.
Cosmetic Variations: Due to the nature of plastic injection molding, minor cosmetic variations (such as slight color shifts, hidden gate marks, or minor knit lines) that do not affect the structural integrity or function of the part are generally considered acceptable, unless strict cosmetic requirements are documented and agreed upon prior to tooling.
5. Limitation of Liability
Production Delays: TWI strives to meet all estimated lead times. However, we are not liable for delays caused by Force Majeure events (e.g., natural disasters, global pandemics, material shortages) or delays in client communication and design approval.
Indirect Damages: In no event shall TWI be liable for any indirect, incidental, loss of profits, or consequential damages arising from the use of our manufactured components. Our maximum liability is strictly limited to the replacement of defective parts or a refund up to the total value of the specific purchase order.
